Event’s Terms and Conditions

Please read these Moroccanoil Collective Event (“Event“) Terms and Conditions (“Terms“) carefully, as they affect your future legal rights. 

All Event tickets, whether or not purchased on the www.moroccanoilprofessionals.com website or otherwise purchased or obtained (“Tickets“), are subject to these Terms. 

By purchasing, holding, or being in possession of a Ticket or by entering the Event, User (as defined below) agrees to all Terms and is legally bound to comply with these Terms. The original Authorized Purchaser (as defined below) agrees to inform all of its Authorized Recipients (as defined below) of these Terms with due diligence. Moroccanoil Israel Ltd., its agents, affiliates, officials, officers, directors, trustees, shareholders, employees, contractors or representatives, and all corporations associated or affiliated with Moroccanoil Israel Ltd., their agents, affiliates, officials, officers, directors, trustees, shareholders, employees, contractors or representatives , and the respective heirs, executors, administrators, other legal representatives, successors and assigns of the aforesaid corporations, individuals and other entities (“Moroccanoil” or “We”) reserves the right, at its discretion, to change, modify, add, or remove portions of these Terms at any time. Please check back periodically for changes. 

AGE REQUIREMENT. Users must be at least 21 years of age in order to attend or participate in the Event in any manner. Any User unable to present valid identification indicating that they are at least 21 years of age will not be admitted to the Event and will not be eligible for a refund.

TICKET PURCHASE.

a) UNAUTHORIZED TRANSFERS PROHIBITED. All Tickets are for use by the original authorized purchaser (each an “Authorized Purchaser”) and their invited guest(s) only (each an “Authorized Recipient”) and are not transferable to any other person.  Authorized Purchasers and Authorized Recipients are referred to individually as a “User.” 

Except as provided herein, Tickets may not be sold, transferred, or used for any form of commercial or trade purposes, including but not limited to promotions, contests, commercial or advertising purposes, or other activities without Moroccanoil’s prior written consent. 

b) FINAL SALE. ALL SALES ARE FINAL. NO REFUNDS OR EXCHANGES. User agrees not to attempt to evade, avoid, or circumvent any refund prohibitions in any manner with regard to the Tickets.

c) TICKET LIMIT. Moroccanoil may limit the number of Tickets any individual or legal business entity may purchase for the Event (a “Ticket Limit”). Moroccanoil reserves the right to cancel any Ticket if it determines, in its sole discretion, any individual or legal business entity has exceeded, or attempted to exceed, the Ticket Limit.

EVENT SUBJECT TO CHANGE/RESCHEDULING/CANCELLATION.

a) EVENT SUBJECT TO CHANGE. Event time and date as well as related activities are subject to change without notice to the User.

b) RESCHEDULED EVENT. If the Event is rescheduled to a different date and time than what appears on the Ticket, Moroccanoil will attempt to contact the Authorized Purchaser to inform the Authorized Purchaser of the refund or exchange procedure applicable to the Ticket, if any. Moroccanoil makes no representation in respect of refund or exchange procedures in the event of a rescheduled Event, as such procedures will be determined by Moroccanoil in its sole discretion on a case-by-case basis.

c) CANCELLED EVENT. If the Event is cancelled, Moroccanoil will issue a refund of the Ticket’s face value paid (or, for a discounted ticket, the discounted Ticket price paid). Refunds will only be issued to the Authorized Purchaser, and will be in the same payment method used by the Authorized Purchaser to purchase the Ticket.

d) PUBLIC HEALTH MEASURES. If the Event is postponed or cancelled due to any public health concern, including the novel coronavirus SARS-CoV-2 and any resulting disease (together with any mutation, adaptation or variation thereof, “COVID-19“), precautions or any public health restrictions, Moroccanoil will communicate notice to the Authorized Purchaser, and the following terms will apply:

i) REDUCTION OF CAPACITY. It is understood that should public health measures restrict originally designated capacities, Tickets may be impacted, including no longer being able to attend the Event. Any User who loses their privilege to attend the Event will be eligible for a refund of the Ticket’s face value paid (or, for a discounted ticket, the discounted Ticket price paid). Refunds will only be issued to the Authorized Purchaser, and will be in the same payment method used by the Authorized Purchaser to purchase the Ticket.

ii) RESCHEDULED EVENT. If the Event is re-scheduled to a different date and time than what appears on the Ticket, Moroccanoil will attempt to contact the Authorized Purchaser to inform the Authorized Purchaser of the refund or exchange procedure applicable to the Ticket, if any. Moroccanoil makes no representation in respect of refund or exchange procedures in the event of a re-scheduled event, as such procedures will be determined by Moroccanoil in its sole discretion on a case-by-case basis.

iii) CANCELLED EVENT. If the Event is cancelled, Moroccanoil will issue a refund of the Ticket’s face value paid (or, for a discounted ticket, the discounted Ticket price paid). Refunds will only be issued to the Authorized Purchaser, and will be in the same payment method used by the Authorized Purchaser to purchase the Ticket.

VIOLATION OF THE TERMS. The Authorized Purchaser is responsible for and shall cause any Authorized Recipient to comply with these Terms, all applicable laws, and all rules, regulations, and policies of all governmental authorities, Moroccanoil, and any other operator of the venue where the Event will be held. Authorized Purchaser agrees to reimburse Moroccanoil for any and all costs incurred by Moroccanoil to repair any damage resulting from or related to a violation of the foregoing, including but not limited to violation of the Age Requirement Section.

AUTHORIZATION OF USER’S IMAGE AND LIKENESS. User grants Moroccanoil (and its designees) the perpetual right to include its image, likeness, actions, and statements in any live or recorded audio, video, film, webcast, stream, image or other transmission, exhibition, simulcast, or reproduction made of, or at, the Event, in whole or in part, in any medium known now or later discovered, including but not limited to, in the print and digital media, by means of digital transmission through the internet, consumer and trade print advertising, newspapers, magazines, internet, Moroccanoil’s and Moroccanoil’s retailers’, distributors’ and trade partners’ websites, emails, digital assets, video-sharing, print and digital advertising, print materials, Moroccanoil owned or sponsored pages on social media, all free and paid editorial, point of sale materials, direct mail, marketing materials, catalogues, brochures, slide or video presentations, DVD, trade materials, event/PR material, internal use, for the purpose of Moroccanoil’s trade, retail, salon, advertisements, editorial, promotions, public relations, education, marketing, social media and other commercial, promotional or non-commercial purposes, without further authorization or otherwise.

ASSUMPTION OF RISK, WAIVER & LIMITATION OF LIABILITY.

a) ASSUMPTION OF RISK. User understands and agrees that there are certain risks associated with attending the Event and all related activities, including, THE POSSIBLE RISK OF SEVERE OR FATAL INJURY TO USER OR OTHERS.  These risks include, but are not limited to, risks associated with travel to and from all venues of the Event, all risks associated with participation in the Event and all related activities, and risks related to COVID-19. User understands and agrees (a) that the risk of exposure to COVID-19 cannot be fully eliminated and is increased by proximity to other people, (b) that an inherent and elevated risk of exposure to COVID-19 exists in any public place or place where people are gathered, (c) that attending the Event may involve coming into close contact with other people, (d) that there is no guarantee, express or implied, that they will not be exposed to COVID-19 and (e) that exposure to COVID-19 can result in being subject to quarantine requirements, illness, disability, and other short-term and long-term health effects, including death. Despite these risks, User voluntarily assume ALL known and potential risk and danger of injury and/or death from any cause, resulting from, in connection with, or incidental to the Event, including exposure to COVID-19. By accepting possession, using any Ticket or otherwise entering the Event, User expressly assumes all risks and dangers arising from or incidental to the Event, whether such risks occur before, during, or after the Event and agrees that Moroccanoil is not responsible for any such risks and dangers, even though such injury, loss or damage may have been caused by Moroccanoil’s negligence. 

b) MEDICAL/HEALTH INSURANCE. User is solely responsible for the selection and purchase of adequate medical/health insurance in relation to the Event. In the event of a medical/health problem, the Moroccanoil accepts no responsibility for any costs associated with a medical/health problem nor will Moroccanoil pay for any medical/health expenses that may be incurred by users.

c) TRAVEL INSURANCE. User is solely responsible for the selection and purchase of adequate travel insurance. The travel insurance should provide cover against theft, personal accident, personal liability, repatriation and cancellation of tickets among other coverages. Moroccanoil accepts no responsibility for any costs associated with these types of issues nor will Moroccanoil pay for any expenses that may be incurred by users relating to or resulting from such issues.

d) WAIVER. User forever releases, waives, discharges and agrees not to sue the following: Moroccanoil, Resorts World Las Vegas Hotel, Event producer(s), Event promoter(s), Event service providers, Event ticketing agency and/or ticketing services provider and their respective parents, subsidiaries, affiliates, partners, owners, members, managers, officers, directors, past and present employees, volunteers, agents, representatives, successors, trustees, successors and assigns (collectively, the “Releasees“) from any known or unknown claims, losses, damages, liability, demands, actions, injury or death, including those relating to COVID-19 or any other illness or injury that User may sustain while at the Event, regardless of whether caused by the negligence or other fault of the Releasees or any third party (collectively, “Claims” or, as used individually, a “Claim“). User further agrees to indemnify, defend, and hold harmless Releasees from any and all claims, demands, liabilities and/or damages arising from all Claims and User’s conduct, acts or omissions during the Event. 

FOR CALIFORNIA RESIDENTS. User understand that the above Waiver applies to Claims which User may not know or suspect to exist and User knowingly and voluntarily waive such rights, including those under California Civil Code Section 1542, which provides: “A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release, and that if known by him or her would have materially affected his or her settlement with the debtor or released party.”

e) MEDICAL CONSENT. User consents to have medical treatment that may be deemed advisable in the event of an injury, accident, or illness during the Event and affirmatively releases the Releasees and all persons participating in such medical treatment from all responsibility for any such actions.

f) LIMITATION OF LIABILITY. To the fullest extent permitted by applicable laws, none of the Releasees are or will be responsible or liable to User or to any third party for, and User expressly waives all rights to seek any indirect, incidental, consequential, special, exemplary, punitive or other damages under any theory of liability, arising out of or relating in any way to the Terms, the Ticket and/or the Event (even if We have been advised of the possibility of such loss or damages, or such loss or damages were reasonably foreseeable).

DISCLAIMERS. Without limiting the generality of anything contained in these Terms, Moroccanoil is not responsible for any lost, stolen or damaged items, no matter how caused. User will not hold Moroccanoil liable for gambling at the venue where the Event will be held or elsewhere, and for any damages associated with it, including gambling losses. Nothing contained in these Terms or the Event shall constitute any intention to induce User or any other person into engaging in any gambling.

PROHIBITED ITEMS. User may not bring any of the following items into the Event (or cause any of items to otherwise enter the Event): illicit substances, glass bottles, aluminum bottles, knives, explosives, sling shots, weapons of any other kind, and other items as designated by Moroccanoil. Moroccanoil reserves the right to refuse admission, reject or remove without refund any person, at Moroccanoil ‘s sole discretion, whose conduct is disorderly, disruptive, potentially dangerous or who fails to follow the Terms or Moroccanoil’s rules or directions, or whose language is vulgar or abusive.

OTHER RIGHTS / RESTRICTIONS. No sponsorship, on site marketing, sampling, vending, coupon/product distribution, or other promotional activity may be conducted at the Event, without Moroccanoil’s prior written approval in each instance. 

FORCE MAJEURE. Moroccanoil will not be responsible for its failure to perform or for delay in performance due to causes beyond its reasonable control and not occasioned by its fault or negligence, such as acts of God, fire, theft, flood, power outage, strike or labour difficulties, war, riot, embargo, or acts of civil or military authorities. In such event, Moroccanoil will use commercially reasonable effort to determine sufficient “make goods”, to the extent reasonably possible.

GOVERNING LAW. The Terms will be governed exclusively by federal and California law, without giving effect to conflict of laws principles thereof. The exclusive venue for any disputes arising out of the Terms and/or Ticket will be the courts of Los Angeles, California. 

NO CLASS ACTION. User waives any right to assert any claims against the releasees as a representative or member in any class or representative action, except where such waiver is prohibited by law. 

PRIVACY POLICY AND TERMS OF USE. The Terms shall be subject to Moroccanoil’s Privacy Policy and Terms of Use, available on www.moroccanoilprofessionals.com, which are also included herein by reference. In the event of any conflict, the Terms shall prevail.

SEVERABILITY. If any provision of these Terms shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of any remaining provisions.
